General Terms and Conditions of Sale

The buyer acknowledges being fully informed that their agreement regarding the content of these general terms does not require a handwritten signature of this document for online orders of products presented by the website's store. The buyer has the option, under their sole responsibility, to save or print these general terms, which are subject to change.
In such cases, the applicable terms will be those in effect on the site at the date of order validation.
All this information is presented in French. The buyer declares and acknowledges having full legal capacity to commit to these general terms and conditions.

1 – Entirety

These general terms and conditions express the entirety of the rights and obligations of the parties.
The buyer is deemed to accept without reservation all the provisions stipulated in these general terms and conditions of sale, with SABAROT WASSNER S.A.S committing to respect its role as a reseller under these terms.

2 – Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties within the framework of online sales of goods and services offered by the company SABAROT WASSNER S.A.S to the buyer.

3 - Contractual Documents

This contract is formed by the following contractual documents, presented in descending order of hierarchy:

- the order form

In the event of contradiction between the provisions contained in these documents, the provisions of the general terms and conditions of sale will prevail.

4 - Effective Date

- duration: these general terms and conditions come into effect on the date of order form validation.

These general terms and conditions are concluded for the necessary duration to supply the subscribed goods and services, until the expiration of guarantees.

5 - Order Validation and Electronic Signature (Law of March 13, 2000, on electronic signatures)

Any order form signed by the buyer by "double click" constitutes an irrevocable acceptance that can only be challenged within the limits provided below in these general terms and conditions of sale, notably "right of withdrawal" and "out of stock".

The "double click" associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

6 - Order Confirmation

Contractual information will be confirmed by e-mail.

Some orders require verification by our verification service. In this case, you will be notified by email of the documents to be sent to obtain final validation of your order. SABAROT WASSNER S.A.S reserves the right to cancel the order in case of non-receipt of these documents or receipt of documents deemed non-compliant.

SABAROT WASSNER S.A.S recommends that the buyer keep a paper or reliable electronic record of the data related to their order. The buyer must verify the completeness and accuracy of the information provided to SABAROT WASSNER S.A.S.

The latter cannot be held responsible for input errors and their consequences in terms of delay or delivery error. In this context, all costs incurred for re-shipping will be borne by the buyer.

7 - Proof of Transaction

Computerized records, kept in the computer systems of SABAROT WASSNER S.A.S under reasonable security conditions, will be considered as proof of communications, orders, and payments between the parties. Archiving of order forms and invoices is done on a reliable and durable medium that can be produced as evidence.

8 - Product Information

- The company SABAROT WASSNER S.A.S presents on its website the products for sale with the necessary characteristics, as communicated by suppliers, in compliance with Article L 111 -1 of the Consumer Code, which provides the possibility for the potential buyer to know before the final order the essential characteristics of the products they wish to purchase.

- The offers presented by the company SABAROT WASSNER S.A.S are valid only within the limits of available stocks.

- The total or partial impossibility of using the products, notably due to hardware incompatibility, cannot give rise to any compensation, refund, or liability of SABAROT WASSNER S.A.S, the buyer remaining solely responsible for the compatibility of the products ordered with those already in their possession.

- SABAROT WASSNER S.A.S guarantees the Buyer against hidden defects that may affect the delivered products, within the framework of a replacement of defective products, or parts making them unsuitable for their use, or their refund, without being considered by the Buyer as responsible for possible damaging consequences that these hidden defects could have caused under conditions.

- The company SABAROT WASSNER S.A.S is subject to the principle of Extended Producer Responsibility and has a unique identifier, which is proof that the company adheres to a waste management channel, in accordance with the provisions of the Anti-Waste Law for a Circular Economy. The unique identifier number of the company SABAROT WASSNER S.A.S is: FR211394_01UOCS. Its suppliers are also subject to the principle of Extended Producer Responsibility, below are their unique identifier numbers: FR215 138_01YTAP.

9 – Price

Prices are indicated in Euros and are only applicable on the date of the order validation sent by the buyer. They do not take into account delivery charges which may be billed in addition and indicated before the final validation of the order.

Prices take into account the T.V.A. applicable on the day of the order, and any change in the legal T.V.A. rate will automatically be reflected in the price of the products presented on the site, on the date stipulated by the implementing decree.

Full payment of the price must be made when ordering, unless a specific offer is indicated on the site. At no time can the sums paid be considered as deposits or down payments.

In the event of an obviously incorrect price display (for example: a low price, a price equal to €0, or a disproportionate reduction compared to the usual price), the order cannot be validated. The company SABAROT WASSNER S.A.S reserves the right to cancel any order including one or more products whose price would be affected by a material or technical error, even if the order has been automatically confirmed by email. In this case, the customer will be informed as soon as possible and will receive a full refund of the amounts paid.

10 - Payment Methods

To pay for their order, the buyer has, at their choice, all the payment methods provided for in the order form: credit card and Paypal.

Payments by credit card and Paypal are collected upon order validation. The buyer guarantees the company SABAROT WASSNER S.A.S that they have the necessary authorizations to use the payment method chosen by them when validating the order form. The company SABAROT WASSNER S.A.S reserves the right to suspend any order management and any delivery in case of refusal of payment authorization by credit card or Paypal by the officially accredited organizations or in case of non-payment.

The company SABAROT WASSNER S.A.S notably reserves the right to refuse to make a delivery or honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

SABAROT WASSNER S.A.S retains full and entire ownership of the products sold until full payment of all amounts owed by the buyer in connection with their order, including fees and taxes. The transfer of ownership of a product purchased from SABAROT WASSNER S.A.S by the buyer to a third party will not be covered by the company SABAROT WASSNER S.A.S. Only the original buyer of this product can claim the clauses of these general terms and conditions of sale.

11 - Dispute

In the event of a dispute, the buyer is informed that they can in any case resort to conventional mediation.

The buyer can resort to mediation services for consumer disputes related to an order made on the site WWW.SABAROT.COM.

The buyer must, before resorting to mediation and contacting the competent mediator, have attempted to resolve their dispute amicably with the professional. It is only in the event of failure or a claim that remains unsuccessful that the mediator can be contacted.

After a prior written declaration of the dispute by the buyer to SABAROT WASSNER S.A.S Customer Service (15 rue courrerie, 43000 Le Puy en Velay), if the settlement of the consumer dispute is not achieved, the mediator can be contacted.

The mediator must be contacted within a maximum period of 1 year from the initial complaint.

SABAROT WASSNER S.AS adheres to the CNPM service (association of the National Chamber of Mediation Practitioners).
