General Terms and Conditions of Sale

The buyer acknowledges being fully informed that their agreement regarding the content of these general terms and conditions does not require a handwritten signature of this document for online orders of the products presented by the website's store. The buyer has the option, under their sole responsibility, to save or print these general terms and conditions, which may be subject to changes.
In such a case, the applicable conditions will be those in effect on the site at the date of order validation.
All of this information is presented in French. The buyer declares and acknowledges having full legal capacity to commit to these general terms and conditions.

1 – Entirety

These general terms and conditions express the entirety of the rights and obligations of the parties.
The buyer is deemed to accept without reservation all the provisions set out in these general terms and conditions of sale, with SABAROT WASSNER S.A.S committing to fulfill its role as a reseller under these conditions.

2 – Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company SABAROT WASSNER S.A.S to the buyer.

3 - Contractual documents

This contract is formed by the following contractual documents, presented in descending order of hierarchy:

- the order form

In case of contradiction between the provisions contained in these documents, the provisions of the general terms and conditions of sale shall prevail.

4 - Effective date

- duration: these general terms and conditions come into effect on the date of order form validation.

These general terms and conditions are concluded for the time necessary to provide the subscribed goods and services until the expiration of the guarantees.

5 - Order validation and electronic signature (law of March 13, 2000, on electronic signatures)

Any order form signed by the buyer with a "double click" constitutes an irrevocable acceptance that can only be challenged within the limits provided hereafter in these general terms and conditions of sale, notably "right of withdrawal" and "stock shortage".

The "double click" associated with the authentication and non-repudiation procedure and with the integrity protection of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

6 - Order confirmation

The contractual information will be confirmed by email.

Some orders require verification by our verification service. In such cases, you will be notified by email of the documents to be sent to obtain final validation of your order. SABAROT WASSNER S.A.S reserves the right to cancel the order in case of non-receipt of these documents or receipt of documents deemed non-compliant.

SABAROT WASSNER S.A.S recommends that the buyer keep a reliable paper or electronic record of the data related to their order. The buyer must verify the completeness and accuracy of the information they provide to SABAROT WASSNER S.A.S.

The latter cannot be held responsible for any input errors and the resulting consequences, such as delays or delivery errors. In this context, all costs for re-shipping will be the responsibility of the buyer.

7 - Proof of transaction

Computerized records kept in the computer systems of SABAROT WASSNER S.A.S under reasonable security conditions will be considered proof of communications, orders, and payments between the parties. The archiving of order forms and invoices is done on a reliable and durable medium that can be produced as evidence.

8 - Product information

- The company SABAROT WASSNER S.A.S presents on its website the products for sale with the necessary characteristics, as communicated to it by the suppliers, in compliance with Article L 111-1 of the Consumer Code, which provides the possibility for the potential buyer to know before the final order the essential characteristics of the products they wish to purchase.

- The offers presented by the company SABAROT WASSNER S.A.S are valid only within the limits of available stocks.

- The total or partial inability to use the products, especially due to equipment incompatibility, cannot give rise to any compensation, reimbursement, or liability on the part of SABAROT WASSNER S.A.S, the buyer remaining the sole judge of the compatibility of the ordered products with those already in their possession.

- SABAROT WASSNER S.A.S guarantees the Buyer, against hidden defects that may affect the delivered products, within the framework of a replacement of defective products, or parts making them unfit for their use, or their reimbursement without the Buyer being able to hold SABAROT WASSNER S.A.S responsible for any harmful consequences that these hidden defects could have caused under conditions.

- The company SABAROT WASSNER S.A.S is subject to the principle of Extended Producer Responsibility and has a unique identifier, which is proof that the company adheres to a waste management channel, in accordance with the provisions of the Anti-Waste Law for a Circular Economy. The unique identifier number of the company SABAROT WASSNER S.A.S is: FR211394_01UOCS. Its suppliers are also subject to the principle of Extended Producer Responsibility, hereinafter their unique identifier numbers: FR215 138_01YTAP.

9 – Price

Prices are indicated in Euros and are applicable only on the date of the order validation by the buyer. They do not take into account any delivery charges that may be billed in addition and indicated before the final validation of the order.

Any potential contribution to the shipping costs requested from the buyer is clearly stated on the site WWW.SABAROT.COM

Prices take into account the VAT applicable on the day of the order, and any change in the legal VAT rate will be automatically reflected in the price of the products presented on the site, on the date stipulated by the implementing decree.

Full payment of the price must be made at the time of the order, except for specific offers indicated on the site. At no time may the sums paid be considered as deposits or advance payments.

In case of displaying an evidently erroneous price (for example: derisory price, price equal to 0 €, or disproportionate reduction compared to the usual price), the order cannot be validated. The company SABAROT WASSNER S.A.S reserves the right to cancel any order including one or more products with a price affected by a material or technical error, even if the order has been automatically confirmed by email. In such a case, the customer will be informed as soon as possible and will receive a full refund of the amounts paid.

10 - Payment method

To pay for their order, the buyer can choose from all the payment methods indicated in the order form: bank card and Paypal.

Payments by bank card and Paypal are collected upon order validation. The buyer guarantees the company SABAROT WASSNER S.A.S that they have the necessary authorizations to use the chosen payment method when validating the order form. The company SABAROT WASSNER S.A.S reserves the right to suspend any order management and delivery in case of refusal of payment authorization by bank card or Paypal from officially accredited bodies or in case of non-payment.

The company SABAROT WASSNER S.A.S particularly reserves the right to refuse to deliver or honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

SABAROT WASSNER S.A.S retains full ownership of the products sold until complete payment of all amounts due by the buyer for their order, including fees and taxes. The transfer of ownership of a product purchased from SABAROT WASSNER S.A.S by the buyer to a third party will not be covered by the company SABAROT WASSNER S.A.S. Only the original buyer of this product can claim the provisions of these general terms and conditions of sale.

11 - Dispute

In case of a dispute, the buyer is informed that they can, in any event, resort to conventional mediation.

The buyer can use the mediation service for consumer disputes related to an order made on the site WWW.SABAROT.COM.

The buyer must, before resorting to mediation and approaching the competent mediator, attempt to resolve their disagreement with the professional amicably. It is only in case of failure or unresolved claim that the mediator can be approached.

Following a prior written declaration of dispute from the buyer to SABAROT WASSNER S.A.S Customer Service (2 rue des Perdrix - 43320 Chaspuzac - France), if the resolution of the consumer dispute is unsuccessful, the mediator can be approached.

The mediator must be approached within a maximum period of 1 year from the initial complaint.

SABAROT WASSNER S.AS adheres to the CNPM service (association of the National Chamber of Mediation Practitioners).
